Terms of Service

Welcome to NestMatch. These Terms of Service (“Terms”) govern your access to and use of the NestMatch website and platform (the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Description of Service

NestMatch is a technology platform that facilitates connections between property managers (“Managers”) and prospective tenants (“Tenants”). NestMatch provides search and matching tools but does not own, manage, or lease any real estate.

NestMatch is not a party to any lease agreement or rental transaction between Managers and Tenants.

2. Fair Housing Compliance

A. Manager Responsibilities

Managers represent and warrant that they will comply with the Federal Fair Housing Act (42 U.S.C. 3601 et seq.) and all applicable state and local fair housing laws. This includes, but is not limited to, the prohibition of discrimination based on race, color, religion, sex, national origin, familial status, disability, or any other protected characteristic.

B. Prohibited Use of Filters

Managers agree that they will use the Platform's search filters (e.g., income, credit score, geography) solely for objective, non-discriminatory business purposes. Use of the Platform to “steer” tenants or to intentionally exclude protected classes is strictly prohibited and constitutes a material breach of these Terms.

C. Geographic Guardrails

To prevent “digital redlining,” NestMatch enforces a minimum search radius of 15 miles. Managers agree not to attempt to circumvent this or any other geographic guardrail designed to ensure Fair Housing compliance.

3. Platform Role and Limitations

A. Not a Consumer Reporting Agency

NestMatch is not a “consumer reporting agency” as defined by the Fair Credit Reporting Act (FCRA). Any tenant profile data, including income and credit score ranges, is self-reported and unverified.

B. Independent Verification Required

Managers are solely responsible for conducting their own independent background checks, credit pulls, and income verification through authorized third-party services before making any tenancy decisions. NestMatch does not perform these services.

C. No Automated Decisions

NestMatch does not make tenancy decisions. The “Invite to Apply” function is a manual action initiated by the Manager. NestMatch is not responsible for the selection or rejection of any Tenant.

4. Disclaimers and Limitation of Liability

A. “As-Is” Service

The Platform is provided on an “as-is” and “as-available” basis. NestMatch makes no warranties regarding the accuracy of tenant-reported data or the suitability of any match.

B. Non-Delegable Liability

Managers acknowledge that their legal obligation to comply with Fair Housing laws is non-delegable. NestMatch shall not be liable for any discriminatory actions, statements, or decisions made by Managers using the Platform.

C. Limitation of Liability

To the maximum extent permitted by law, NestMatch and its owners shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Platform.

5. Termination

NestMatch reserves the right to suspend or terminate the account of any user who violates these Terms, including any user suspected of discriminatory practices or Fair Housing violations.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles.

By using NestMatch, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
